Terms of Service

Last updated: October 1, 2026

1. About these terms

These Terms of Service ("Terms") govern your use of the Cinatre website, platform and apps (the "Service"). The Service is operated under the brand CINATRE™ by Iuliia Mostova, NIE Y8498668K, Carrer d'Indibil 6, 08004 Barcelona, Spain ("Cinatre", "we", "us"). By creating an account or using the Service, you agree to these Terms and confirm you have read our Privacy Policy. If you do not agree, do not use the Service.

2. Your account

2.1 You must be at least 16 years old to create an account. To subscribe, buy titles or submit content as a creator, you must be 18 or have permission from a parent or legal guardian, who accepts these Terms on your behalf.

2.2 You agree to give accurate information when registering, keep your login details secure, and tell us promptly if you suspect unauthorised use. You are responsible for activity under your account.

2.3 You can use your account on any number of devices and share it with members of your household. You may not sell, rent or publicly share your login details.

2.4 You need an account to watch anything on Cinatre. Free content, such as trailers and interviews with creators, is available to everyone with an account. All other titles require a subscription or an individual purchase.

3. Subscriptions and purchases

3.1 Subscription A monthly subscription gives access to all titles marked as included in the subscription. Some titles are available only by individual purchase, even for subscribers.

3.2 Purchases Individual titles can be bought for a one-time price set by the creator. Buying a title gives you a personal, non-transferable right to stream it through the Service. It does not transfer ownership or allow downloading, unless the Service offers a download option.

3.3 Prices and payment Prices are shown at checkout and include VAT where applicable. Payments are processed by Stripe. We never see or store your full card number.

3.4 Renewal and cancellation Subscriptions renew automatically each month until cancelled. You can cancel at any time in your account settings. Access continues until the end of your current billing period, and we do not refund partial months except as set out in 3.5 or required by law.

3.5 Right of withdrawal (EU consumers) Purchases: when you buy a title, you ask us to make it available immediately and acknowledge that you lose your 14-day right of withdrawal once you start streaming it. Subscriptions: you may withdraw within 14 days of your first subscription payment. If you have already used the Service in that time, we refund the amount paid minus a proportionate charge for the days used.

3.6 Price changes We will give subscribers at least 30 days' notice by email before a price change. The new price applies from your next billing period after that notice. You can cancel before it applies.

3.7 Your library Titles you buy stay in your library for as long as you keep your account and we operate the Service, including if the creator later removes the title from sale (see section 5.3). If we must remove a title you bought for legal reasons, or if a title cannot be played because of a fault on our side that we cannot fix, we will refund your purchase price.

3.8 Closing the Service If we ever close the Service, we will give at least 60 days' notice and refund any unused part of a subscription.

3.9 Personal use Your subscription and purchases are for personal, non-commercial viewing on your own devices. Showing a Cinatre title at a public screening, event, venue or class, or streaming it to others online, requires the creator's written permission.

3.10 Streaming quality Picture and sound quality depend on your device, internet connection and location, and not every title is available in every format. Any internet or mobile data charges are your responsibility.

3.11 Failed payments If a subscription payment fails, we will tell you by email and you can update your payment details in your account. Access to subscription titles is paused until payment succeeds or you cancel. Titles you have bought stay available.

3.12 Promotional codes We may offer promotional, festival or referral codes. Each code is for personal use, cannot be sold, shared publicly or exchanged for cash, and may expire or be withdrawn. Only one code can be used per purchase unless we say otherwise.

4. Creator submissions

4.1 Your promises When you submit content, you confirm that you own or control all rights in it, including music, footage, images, scripts and performances, and that it does not infringe anyone's intellectual property, publicity, privacy or moral rights. You confirm that everyone appearing in it has agreed to appear and to its distribution on Cinatre, and that a parent or legal guardian has consented for any minor who appears.

4.2 Review Every submission is reviewed by Cinatre before publication. We may approve or decline a submission at our discretion. If we decline it, we will tell you why, and you may resubmit an improved version.

4.3 Submission fee A one-time submission fee applies to each approved video, currently €17.99 for short films and €23.99 for feature films, documentaries and theatre recordings. The current fee is always shown before you submit. By submitting, you authorise us to charge the fee to your saved card only if the video is approved. Declined videos are never charged. The fee is waived for winners of a Cinatre competition, under that competition's rules. Once charged, the fee is non-refundable except where the law requires otherwise.

4.4 Paid titles If you offer a title for purchase, you must also upload a trailer or teaser. The trailer is free to watch and is shown before the purchase option.

4.5 Accurate details You must give accurate titles, credits, descriptions and content warnings for your submission.

4.6 Language Content may be in any language. You must state the language of your content and are responsible for any subtitles or translations.

4.7 Free access for creators From your first approved upload, you get free access to all subscription titles for as long as your creator account remains open and in good standing.

4.8 Unsolicited pitches Cinatre accepts finished work only through Creator Studio or official Cinatre competitions. We do not accept unsolicited scripts, treatments or project ideas by email or message, and we may delete them without reading them. Sending one creates no obligation for Cinatre.

5. Ownership and licence

5.1 You keep ownership You keep all rights in your content. Nothing in these Terms transfers ownership to Cinatre.

5.2 Licence to Cinatre By publishing content on Cinatre, you grant us a non-exclusive, worldwide licence, for the period described in 5.3, to host, store, encode, copy and stream it to users of the Service in the formats needed. You also allow us to use your title, name, credits, trailer, thumbnails, stills and excerpts of up to 60 seconds to promote your content and Cinatre, including on social media and in competition or festival materials. We will always credit you as the creator.

5.3 Unpublishing and archiving You can unpublish your content at any time from Creator Studio. Unpublished content is removed from browsing, search, the subscription catalogue and new sales. Viewers who bought it before you unpublished it keep access in their library, and your licence to us continues only for that purpose. We will not create new promotional material for unpublished content, but we are not required to remove posts already published.

5.4 Removal for legal reasons If content must be removed because it infringes someone's rights or breaks the law, we may also remove it from buyers' libraries. Where this results from a breach of your promises in 4.1, refunds we give to buyers may be deducted from your earnings.

5.5 Claims You are responsible for claims made against Cinatre by third parties arising from a breach of your promises in 4.1, including reasonable legal costs.

5.6 No AI training We will never use your content, including films, recordings, trailers, images, scripts and descriptions, to train or improve artificial intelligence models, and we will never license or sell it to anyone for that purpose.

6. Creator earnings and payouts

6.1 Purchases When a viewer buys your title, you receive 60% of the purchase price excluding VAT. Cinatre keeps 40% to cover platform, video delivery and payment processing costs. You set your price within the range for your category shown in Creator Studio.

6.2 Subscriptions and grants Subscription revenue is retained by Cinatre and is not shared with creators per view. Cinatre may allocate part of its revenue to an annual creator grants programme. The amount and allocation are decided by Cinatre each year and may vary. Grants are awarded under separate rules published before each round and are paid with your monthly payout.

6.3 Payouts We pay your earnings (purchases, tips and any grants) once a month, around the 30th, using the details you enter in Creator Studio: SEPA bank transfer for creators in the EU (IBAN required) or PayPal for creators outside the EU. The minimum payout is €10. Smaller balances carry over to the next month. Any fees charged by your bank or PayPal to receive the transfer are paid by you. You can see your earnings in Creator Studio at any time.

6.4 Refunds and chargebacks If a purchase or tip is refunded or reversed, the related earnings are deducted from your balance.

6.5 Invalid activity Views or purchases from your own account, automated tools, or any attempt to manipulate earnings do not count. We may withhold earnings linked to such activity while we investigate.

6.6 Taxes You are responsible for taxes on your earnings. We may be legally required to collect your tax details and report your earnings to tax authorities, including under EU rules for digital platforms (DAC7). We cannot pay out until you provide them.

6.7 Changes We will give at least 30 days' notice before changing the revenue split, the creator support fee or submission fees. Changes never apply to earnings already accrued.

6.8 Creator support (tips) Viewers can support a creator with a voluntary tip of an amount they choose. The creator receives 90% of the tip and Cinatre keeps 10%. Payment processing fees are shown at checkout, and supporters can choose to cover them so the creator receives the full amount. Supporters receive nothing in return, the creator is not obliged to use tips for any specific project, and tips are non-refundable except in case of error or fraud. The creator sees the supporter's display name, the amount and any message.

7. Content standards

7.1 Cinatre does not accept adult content. You may not upload:

  • sexually explicit content, pornography or nudity of any kind, including in an artistic context;
  • any content that sexualises minors;
  • content that is unlawful or infringes anyone’s rights;
  • hate speech, or content that harasses, threatens or discriminates against people;
  • content that promotes or glorifies violence, terrorism, self-harm or suicide;
  • content that shares someone’s private information without their consent;
  • misleading titles, descriptions or credits.

7.2 Films and plays may explore mature themes, such as violence, strong language or drug use, as part of the story. Such content must carry the content warning selected at upload.

7.3 We may decline, restrict or remove content that breaks these standards, as described in section 8.

8. Reporting content and moderation decisions

8.1 Reporting Anyone can report content they believe is illegal or breaks these Terms, using the report option on the title page or by emailing cinatre.streaming@gmail.com. Please include where the content is, why you think it breaks the law or these Terms, and your contact details. We review reports promptly and fairly.

8.2 Our decisions If we remove or restrict your content, or suspend your account, we will tell you the reason and how to challenge the decision, unless the law prevents us from doing so.

8.3 Appeals You can challenge a decision within 6 months by emailing cinatre.streaming@gmail.com. A person, not an automated system, will review your appeal and reply.

8.4 Misuse We may suspend accounts that repeatedly upload content breaking these Terms, or repeatedly send reports that are clearly unfounded.

8.5 Authorities Where required by law, we report content suggesting a threat to someone's life or safety to the relevant authorities.

9. Acceptable use and the Cinatre brand

You agree not to: get around access controls or content protection; download, copy, record or redistribute content beyond what the Service allows; scrape, crawl or collect content or data from the Service by automated means; use any content or data from Cinatre to train or improve artificial intelligence models; overload or disrupt the platform; or use the Service for any illegal or unauthorised purpose.

CINATRE™ is a trademark, with a trademark application filed at the Spanish Patent and Trademark Office (OEPM). The Cinatre name, logo and design of the Service may not be used without our written permission, except to refer accurately to your own content on Cinatre (for example, "Now streaming on Cinatre").

10. Termination

10.1 You can close your account at any time. If you close it, you lose access to titles you bought, so please consider this first.

10.2 We may suspend or close your account if you seriously or repeatedly break these Terms, following the process in section 8.

10.3 If a creator account is closed, we pay out earnings owed, except earnings withheld under 6.5.

10.4 Sections that by their nature should continue after closure remain in effect, including sections 5, 6 (for earnings owed), 11 and 13.

10.5 Fraud protection To protect viewers, creators and Cinatre, we may temporarily hold an account, payment or payout if we suspect fraud or misuse. We will tell you and review the hold as quickly as possible.

11. Disclaimers and liability

11.1 We work to keep the Service available and working well, but we cannot promise it will always be uninterrupted or error-free.

11.2 To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or €100.

11.3 Nothing in these Terms limits our liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or any liability that cannot be limited by law. Nothing in these Terms affects your rights as a consumer.

11.4 Events beyond our control We are not responsible for delays or interruptions caused by events beyond our reasonable control, such as internet or power outages, failures of our service providers, natural disasters, war or government action.

12. Changes to these terms

We may update these Terms. We will give at least 30 days' notice of material changes by email or in the Service. If you do not agree, you can cancel or close your account before the changes apply. Continued use after that date means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by Spanish law. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and can bring a claim in your local courts. Otherwise, the courts of Barcelona have jurisdiction.

If any part of these Terms is found invalid, the rest remains in effect. Your account and these Terms are personal to you and cannot be transferred to anyone else without our permission. If we do not enforce a right straight away, we have not given it up.
